Joshua B. Schwartz is a Philadelphia personal injury attorney and Shareholder at Eisenberg Winkler Jeck Schwartz Schoenhaus & Sherry. For his entire career, over 18 years, Josh has committed his practice to representing plaintiffs in complex wrongful death and catastrophic injury matters. At the firm, Josh primarily handles cases involving medical malpractice, product liability, and other catastrophic personal injury matters.

As a personal injury attorney, Josh has investigated and litigated hundreds of complex cases. His work has resulted in numerous multimillion-dollar verdicts and settlements for catastrophic injury victims and their families, including groundbreaking results, such as what is believed to be one of the largest medical malpractice settlements in Pennsylvania history, and the settlement in the Boy Scouts of America sexual abuse litigation, which at the time was the largest sexual abuse settlement in U.S. history.

Josh is the past Chair of the Future Leaders Section of the Pennsylvania Association for Justice and the Philadelphia Trial Lawyers Association. He currently serves on the Board of Governors of the Pennsylvania Association for Justice and on the Board of Directors and as an Officer of the Philadelphia Trial Lawyers Association, serving as Secretary.

$2.46 Billion Boy Scouts of America Sexual Abuse Settlement

At the time of the Boy Scouts of America’s bankruptcy proceedings and the formation of the Plan of Reorganization in connection with the tens of thousands of sexual abuse cases brought against the organization, Eisenberg Winkler Jeck Schwartz Schoenhaus & Sherry, along with its co-counsel, represented the largest group of claimants in the U.S.

Stewart Eisenberg and Josh’s efforts on behalf of their clients in pursuing their sexual abuse claims and negotiating the $2.46 billion settlement trust were instrumental in bringing about what was then the largest sexual abuse settlement in U.S. history.

$54 Million Delay in the Diagnosis and Treatment of an Ischemic Stroke Case Settlement (Confidential)

Josh and Daniel Jeck secured a confidential $54 million settlement in a case where our client suffered brain damage from a basilar artery stroke that remained undiagnosed and untreated by multiple providers.

This settlement is believed to be one of the largest medical malpractice settlements in the history of the Commonwealth of Pennsylvania.

$14 Million Endovascular Embolization Surgery Case Settlement (Confidential)

Josh and Daniel Jeck secured a confidential $14 million settlement in a case where our client suffered a series of strokes and debilitating, irreversible brain damage after a neurosurgeon performed an endovascular embolization surgical procedure to seal off a brain aneurysm.

$8 Million Product Liability Case Settlement (Confidential)

Josh and Daniel Jeck secured a confidential $8 million settlement in a case where a six-month-old child was infused with a solution that contained ten times the prescribed dose of sugar in the concentration. The boy went into shock, suffered a stroke, and now has permanent brain damage.

$7.15 Million Defective Seatbelt Case Settlement (Confidential)

Josh and Daniel Jeck secured a confidential $7.15 million settlement in a case where the seatbelt in our client’s 1999 Jeep Cherokee became unlatched during a crash, causing him to suffer paralyzing injuries.

$6.7 Million Medical Malpractice Case Settlement (Confidential)

Josh and Daniel Jeck secured a confidential $6.7 million settlement in a case where our client’s doctors failed to timely and appropriately evaluate, diagnose, and treat her hematological condition, Thrombotic Thrombocytopenic Purpura (“TTP”), which resulted in her untimely death.

$4 Million Nephrectomy/Colectomy Case Settlement (Confidential)

Josh and Daniel Jeck secured a confidential $4 million settlement just before trial was to begin in a case where our client became disabled from a post-operative infection that developed after a partial nephrectomy/colectomy to remove early-stage cancer. Because of the infection, our client was hospitalized multiple times and needed multiple surgeries, culminating in a total small bowel transplant.

Education

Josh received his Bachelor of Arts Degree in Communication Arts and Sciences with a concentration in Rhetorical Theory from The Pennsylvania State University. He also completed a semester abroad at The Charles University in Prague, Czech Republic.

Then, Josh earned his law degree from Widener University School of Law, where he received Widener Law’s Outstanding Student Service Award, as well as the President’s Service Award. While attending law school, Josh served as a law clerk to the Honorable Robert J. Matthews and Honorable Paul P. Panepinto in the Complex Litigation Center of the Philadelphia County Court of Common Pleas.

Community Involvement

Josh gives back to the community by representing indigent clients pro bono. He is also the co-founder of The Spruce Foundation, a non-profit organization dedicated to helping Philadelphia youth.
