Results

$265 Million Settlement in Amtrak Train No. 188 Derailment

In May 2015, Amtrak train No. 188, traveling to New York City, sped around a curve in Philadelphia and derailed, causing over 200 injuries, including eight deaths. An investigation by the National Transportation Safety Board concluded the crash was caused by the engineer mistakenly accelerating around the curve instead of decelerating.

Working as part of the Plaintiff’s Management Committee to handle the Multi-District Litigation, Fred and Todd Schoenhaus were able to secure a historic $265 million settlement to ensure that all victims would be compensated for their injuries and losses in a timely manner.

It is believed to be the largest such settlement in railway history.

$65 Million Dram Shop Case Settlement (Confidential)

Fred, Stewart Eisenberg, Dan Sherry, Jr., and Jess Colliver secured a confidential $65 million dram shop settlement on behalf of two families from New York after a car carrying four occupants, none of whom were married, was hit head-on by a drunk driver who had been over-served a significant amount of alcohol at a resort facility, killing two and leaving the other two permanently injured.

It is believed to be one of the largest dram shop settlements in the history of the Commonwealth of Pennsylvania.

$36.5 Million Defective Tire Case Settlement (Confidential)

Fred, Dan Sherry, Jr., and Jess Colliver secured a confidential $36.5 million settlement in a defective tire case involving a 20-year-old tire.

$35 Million Defective Tire Case Settlement (Confidential)

Fred, Dan Sherry, Jr., and Jess Colliver secured a confidential $35 million settlement in a defective tire case in which the defective tire caused an RV to crash, resulting in the death of an elderly woman.

$20 Million Roadside Services Settlement (Confidential)

Fred, Nancy Winkler, Dan Sherry, Jr., and Jess Colliver secured a confidential $20 million settlement in a case in which negligent roadside service resulted in an SUV crash that caused the death of an elderly man.

$10 Million Toxic Chemical Case Settlement (Confidential)

Fred, Dan Sherry, Jr., and Jess Colliver secured a confidential $10 million settlement in a case where our client was killed when toxic chemicals in the trunk of her vehicle emitted poisonous fumes.

$10 Million Defective Seatbelt Case Settlement (Confidential)

Fred, Dan Sherry, Jr., and Jess Colliver secured a confidential $10 million settlement in a case where our client was injured when his SUV rolled over, and his seatbelt failed to prevent him from striking the vehicle’s roof.

$10 Million Rollover Automobile Accident Case Settlement

Fred, Stewart Eisenberg, and Dan Sherry, Jr., secured a $10 million settlement in a case where, en route to an athletic event, a New York City high school’s van, driven by one of its coaches, left the road, rolled over, and severely injured a high school athlete. Although

wearing a seatbelt, the student was partially ejected from the van and is now a wheelchair-dependent quadriplegic.

Fred and Dan filed lawsuits against (i) New York City, alleging that it was responsible for the negligent actions of the high school and coach, (ii) the van’s manufacturer, alleging it negligently designed the passenger van because it lacked airbags to prevent occupant ejection during a rollover, and (iii) the automotive parts company that supplied the seatbelt, alleging that it negligently designed a seatbelt that did not provide reasonable restraint.

At the time, this settlement ranked among the five largest settlements New York City had ever agreed to in a civil lawsuit against it.

$9.25 Million Fatal Motorcycle Accident Case Settlement (Confidential)

Fred and Dan Sherry, Jr., secured a confidential $9.25 million dollar settlement in a fatal motorcycle accident that claimed the life of our client.

$7.5 Million Death of Unborn Child Medical Malpractice Case Settlement (Confidential)

Fred and Brian Hall secured a confidential $7.5 million settlement on behalf of our client, who was the victim of medical malpractice at the hands of a hospital and its physicians. Their malpractice caused the death of our client’s baby and caused her to suffer many injuries, including permanent brain damage.

Education and Experience in Personal Injury Law

Fred earned his undergraduate degree from the University of Pennsylvania in 1984 and his law degree from Temple University School of Law in 1987.

He began his legal career at the New York City firm Labaton Sucharow, where he spent five years representing individuals and families harmed by corporate misconduct in high-profile securities class actions. In 1992, Fred joined Litvin, Blumberg, Matusow & Young, where he quickly rose to become a shareholder. In 2004, he was named a shareholder at Eisenberg Winkler Jeck Schwartz Schoenhaus & Sherry, P.C.

Fred’s practice focuses on complex, catastrophic cases on behalf of severely injured plaintiffs. Over the years, he has successfully handled cases involving product liability and automobile defects, medical malpractice, construction site and workplace accidents, and commercial vehicle/trucking accident cases.
