Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck Secures Nearly $1 Million Settlement in Subtle Head Injury Case

Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck attorneys Frederic Eisenberg and Brian Hall recently confidentially settled for nearly $1,000,000 a lawsuit on behalf of a client who suffered a head injury after being discharged from a hospital.

The case, which was brought in a suburban county outside of Philadelphia, concerned a 26-year-old woman who was left unattended after she was discharged from a local emergency room. Although she was a known fall risk and was unsteady as she left the emergency room, hospital staff left her at the hospital curbside alone to wait for her ride home.

While waiting, she fainted. When she fell to the ground, she hit her head and sustained a mild concussion. Although head imaging studies were negative and she had pre-existing neurologic conditions, Fred and Brian were able to secure a favorable result for their client. Fortunately for her, she has been able to move forward with her life.

“This case is yet another example of how Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck attorneys add significant value to our clients’ cases,” said Fred. “We aggressively investigate what happened and why it happened, and then we build a case against a defendant that makes clear they could be looking at significant legal and financial exposure for their actions.”

“Many law firms would have looked at the facts of this case and that it took place in a suburban county where juries are often unfriendly to injured plaintiffs, and passed on it,” said Brian. “But Fred and I knew that our client was wronged, and that we could favorably resolve this case for her by holding the defendants’ feet to the fire. That’s exactly what we did here.”
