Phila. Judge Urges Upholding $55.3M Crashworthiness Award Against Honda

Gina Passarella, The Legal Intelligencer September 22, 2015 A Philadelphia trial judge has rejected the 25 issues Honda has raised in its appeal of a $55. Philadelphia Court of Common Pleas Judge Shelley Robins New was not persuaded by American Honda Motor Co. ’s arguments that Philadelphia was an inconvenient forum or that the court improperly admitted evidence of alternative seat-belt designs that were developed after the car was manufactured but before the accident at issue occurred.

Victim’s Family Sues Bus Company in Fatal N.J. Turnpike Crash

Ken Rothweiler and Fred Eisenberg represent the family of a young man from Philadelphia who was killed in a tour bus accident on the New Jersey Turnpike. The company named in the lawsuit, Super Luxury Tours of Wilkes Barre, was found to be violating several federal regulations on safety and has since been shut down.

Watson Pharmaceuticals Recalls Fentanyl Transdermal Patches

Fentanyl Transdermal Patches sold in the United States between January and March 2008 are being recalled by Watson Pharmaceuticals due to a defect in the patch manufacturing. Patches affected by the recall are of the 75 mcg/hr variety with an expiration date of August 31, 2009 and lot number 92461850; no other lots are affected by this recall.

Eisenberg Rothweiler Files Lawsuit for Couple Injured in the Amtrak Train Derailment

Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck, P. C. , have filed a lawsuit in federal court against Amtrak and the train engineer on behalf of their clients, who were severely injured in the Amtrak 188 regional train derailment. In an article from the Philadelphia Inquirer, Eisenberg Rothweiler partner Nancy J. Winkler was asked about the ramifications of the Amtrak Reform and Accountability Act that limits the amount of damages the government can award to victims and replied, “You can assume almost everyone suffered some kind of injury, when you have someone who is alive and needs ongoing medical care for the rest of their life, the cost can be $15 million or $20 million or more. ”

2 million verdict for the family of a young man who died from complications of pneumonia which were not properly treated by his physician. Eisenberg and Privitera were able to prove that the doctor fell below the standard of care by not admitting the plaintiff to the hospital despite numerous signs of worsening infection and pneumonia.
